General Terms and Conditions "Victory Umzüge"

  1. Scope
    These General Terms and Conditions (hereafter: GTC) apply to the booking of moving services by customers (hereafter: Customer) of Victory Umzüge, An der Nachtweide 29, 60433 Frankfurt am Main
    (hereafter: Victory Umzüge). All services provided by Victory Umzüge to the Customer are exclusively based on these General Terms and Conditions. Any differing, conflicting, or supplementary GTC of the Customer will not become part of the contract.

  2. Services
    Victory Umzüge fulfills its obligations with the utmost care while protecting the Customer’s interests in return for the agreed payment. If unforeseen expenses arise during the contractual services, the Customer must cover these costs if deemed necessary by Victory Umzüge. Should the Customer expand the scope of services after the contract, the resulting additional costs must be compensated accordingly. Employees are not authorized to perform electrical, gas, dowel, or other installation work. Hazardous goods or items requiring special permits are excluded from transport unless agreed in writing.

  3. Carriers/Shared Load
    Victory Umzüge handles the move itself and does not hire another carrier for the relocation. The move can be conducted as a shared load transport.


  4. Data Protection
    Victory Umzüge uses the data provided by the Customer solely for the fulfillment and processing of the order. The data will not be shared with third parties.


  5. Customer Obligations / Transport Security
    The Customer must provide truthful and complete information, especially about the moving locations (e.g., local conditions, walking distances, square footage, number of rooms, elevator/floor details, etc.). A complete list of items to be moved must be provided to Victory Umzüge by the requested date. The Customer is responsible for properly preparing and packing the items unless additional services have been booked. They must also secure any necessary parking permits and provide all required documents for the move. Victory Umzüge is not responsible for verifying transport security.
  6. Customer Inspections

    Upon collection of the items, the Customer is obligated to check that no items are mistakenly taken or left behind. The Customer must ensure their presence or that of an appointed representative throughout the entire moving process.


  7. Payment Terms
    For domestic moves, payment is due before unloading, and for international moves, payment is required before loading. Payment must be made in cash or an equivalent form. Foreign currency expenses must be settled at the exchange rate used. If the sender fails to pay, Victory Umzüge may hold or store the items at the sender’s expense. Payment options include:
    a. PayPal (3% fee)
    b. EC card (3% fee)
    c. Prepayment/Bank transfer (no fee)
    d. Cash (no fee)


  8. Increase in Compensation
    If additional costs arise after the contract has been signed, due to incorrect or incomplete information from the Customer or changes in walking distances, Victory Umzüge reserves the right to charge for the extra effort. This also applies if the Customer expands the scope of services, such as by adding extra services after the contract has been agreed upon.


  9. Cancellation and Fees
    The sender may cancel the moving contract at any time. If the customer cancels before the move, the following fees apply:
    a. Cancellation more than 14 days before the move: 30% of the total cost.
    b. Cancellation within 5 days before the move: 50% of the total cost.
    c. Cancellation within 1 day before the move: 100% of the total cost.


  10. Change of Moving Date After Contract Signing
    A change in the moving date after the contract has been signed is possible, provided the new date is available at the time of the request.


  11. Consumer Dispute Resolution Act
    We hereby inform you that we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

    Choice of Law
    German law applies.

  13. Liability Provisions
    Victory Umzüge is liable for any damage or loss of goods while they are under its care. Liability for loss or damage is limited to €620 per cubic meter of cargo space required for the contract, as per § 451 e HGB. Customers have the option to insure their goods beyond this legal liability. Victory Umzüge can arrange additional transport insurance upon the customer’s request and for an additional fee.

  14. Special Exclusions of Liability
    Victory Umzüge is exempt from liability under § 451 d HGB if loss or damage is due to the following:
    a. Transport/storage of valuables like gold, jewels, money, or documents
    b. Inadequate packaging or labeling by the sender
    c. Handling, loading, or unloading by the sender
    d. Goods not packed by the mover
    e. Goods that don’t fit the loading site and are damaged after a warning
    f. Transport of live animals or plants
    g. Natural or poor condition of the goods prone to damage (e.g., breakage, rust).

  15. Damage Report
    Visible damages or losses must be reported to Victory Umzüge no later than the next day after delivery in detailed written form (email or letter) per § 451 f Nr.1 HGB. A simple note on a receipt is insufficient. Oral complaints are allowed only if made at the time of delivery. Hidden damages must be reported within 14 days. If damages are not reported within these timeframes, the customer’s liability claims expire. Timely submission of a detailed written report is required to maintain claims.
